This Privacy Policy describes how Viraways (“Viraways,” “us,” “we,” or “our”) collects, uses, and discloses information, and what choices you have with respect to that information. We are committed to maintaining the confidentiality, integrity, and security of your information.

In this Privacy Policy, “you” and “your” refer to individual users of Viraways' APIs and tools that help financial services and software companies get data on businesses, automate decisions, and manage fraud, credit, and compliance risk (collectively, the “Services”). This Privacy Policy is incorporated into, and considered a part of, the Viraways Terms of Service.

1. Applicability of This Privacy Policy

This Privacy Policy applies to the Services, the Site, and other interactions you may have with Viraways (e.g., customer service inquiries, form submissions). If you do not agree with the terms of this Privacy Policy, do not access or use the Services, the Site, or any other aspect of Viraways' business.

In using our Services, Customer collects and manages information about its own customers (which is considered Customer Data) and routes that information to other services. A separate Customer Agreement governs the processing of Customer Data. The organization that entered into the Customer Agreement controls its instance of the Services and any associated Customer Data.

This Privacy Policy does not apply to any third-party applications or software that integrate with the Services or the Site. We are not responsible for the privacy practices or content of those third-party services.

3. A Note About Children

Our Site and Services are not intended for children under 18 years of age. We do not intentionally gather or process Personal Data about individuals under 18. If we inadvertently hold such data, please let us know so we can delete it.

4. Types of Personal Data We Collect

“Personal Data” means data that allows someone to identify you or your customers, including name, address, telephone number, payment information, and email address. “Anonymous Data” means data that is not associated with or linked to your Personal Data.

Personal Data you provide. We collect first and last name, email address, telephone number, company name and address, payment information, and password when you register for the Services, request a demo, apply for a job, or contact us for support.

Personal Data collected by third parties. We may receive Personal Data about you from companies that provide services to us (such as payment processors), from the Customer, or from Google if you choose to log in through Google.

Usage information. We collect information about how you use the Services and Site, which may include IP address, search terms, pages viewed, and device, browser, and operating system type and version.

Cookies and other identifiers. We and our service providers use industry-standard identifiers such as cookies to remember returning visitors, optimize your experience, support advertising and marketing, and gather anonymous statistics. Most browsers accept cookies by default; you can refuse them through your browser settings, though this may impair some features.

5. Purpose of Processing and Legal Basis

We collect and process your Personal Data for the following purposes and legal bases:

  • To create and secure your account and identify you as a user;
  • To provide customer support and respond to your inquiries;
  • To provide, improve, develop, protect, and promote our Site and Services;
  • For billing, account management, and administrative services;
  • To prevent abuse of the products and services we offer;
  • As required by applicable law, legal process, or regulation;
  • To send administrative notifications such as security or maintenance advisories;
  • To send, with your consent, marketing and advertising communications; and

6. Disclosure of Your Personal Data

We do not sell, license, or share your Personal Data with unaffiliated third parties for their own marketing purposes.

Service providers. We use third-party service providers to act on our behalf, for example to process payments or personalize your experience. They may only use your Personal Data for the specific service they provide.

Changes to our business. Your Personal Data may be transferred to another organization in connection with a merger, acquisition, or asset transfer, subject to this Privacy Policy.

Safety, security, and law. We may disclose Personal Data where reasonably necessary to prevent fraud or harm, protect our rights, or comply with applicable law, regulation, or legal process.

7. Choice / Opt-Out

You may subscribe to or opt out of marketing communications at any time using the unsubscribe links we provide or through your account preferences. Even if you opt out, you will still receive transactional and account-related communications, which are part of the Services.

8. Data Changes and Retention

Changes and deletion. You may change certain aspects of your Personal Data within your account, or email us to request changes, updates, or deletion. We may be required by law to retain some information.

Data controlled by our Customers. Viraways has no direct relationship with individuals whose Personal Data is contained within Customer Data. Such individuals should direct access, correction, or deletion requests to the relevant Customer.

Data retention. We retain data we process for as long as needed to provide services to our Customer or as required by applicable law, to resolve disputes, and to enforce our agreements.

9. Security

Viraways uses commercially reasonable and industry-standard technical and organizational measures designed to prevent unauthorized access, use, alteration, or disclosure of Personal Data. However, no method of transmission or storage is absolutely secure, and we cannot guarantee absolute security.

10. Your Rights

Under applicable law, you may have the rights (subject to conditions) to: access and request copies of your Personal Data; request correction, supplementation, or deletion; request that we restrict processing; object to processing or revoke consent; request data portability; know the identities of third parties to which your data is transferred; and lodge a complaint with the competent authority.

11. Transfer of Data Outside Your Country

To provide the Services, we may store, process, and transmit data in locations around the world, including outside your country. By using the Services, you consent to the transfer of your information to our facilities and those of third parties as described in this Policy.

13. Changes to This Privacy Policy

If we make changes to this Privacy Policy, they will be posted on the Site in a timely manner. Any changes become effective upon posting. If we make material changes, we may notify you by email or by a notice on the Site. Continued use of the Services following such changes constitutes your acceptance of the revised Privacy Policy.
